Welcome to Air Aware, a webtool designed to provide air quality information and related services. The webtool is developed and maintained by OpenKit, a company registered in the United Kingdom, in collaboration with various councils across the UK.

Please read these Terms and Conditions ("Terms") carefully before using the Air Aware webtool hosted at https://air-aware.co.uk ("the Webtool"). Your access to and use of the Webtool is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Webtool.

1. Acceptance of Terms

By accessing or using the Webtool, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Webtool.

2. Use of the Webtool

Air Aware provides a platform for users to access air quality information and related services. The Webtool uses OpenAI's GPT-3.5 language model to provide responses to user queries.

You agree to use the Webtool only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Webtool. You must not misuse the AI model by attempting to make it generate inappropriate or offensive content.

The Webtool also incorporates external sources of information to provide a comprehensive service. While we strive to ensure the accuracy of this information, we cannot guarantee its correctness at all times.

3. Intellectual Property

All intellectual property rights in the Webtool, its content, and the underlying software and technology, including but not limited to text, graphics, logos, and images, are owned by the respective councils (Newham, Hackney, Tower Hamlets, and the City of London) and are protected by copyright laws and treaties around the world.

4. User Accounts

To access certain features of the Webtool, you may be required to register for a user account. You agree to provide accurate and complete information during the registration process and to update such information as it changes.

5. Privacy

Your use of the Webtool is also governed by our Privacy and Cookie Policy, which can be found at air-aware.co.uk/privacy-notice, which are incorporated into these Terms by reference.

6. Limitation of Liability

To the extent permitted by law, OpenKit will not be liable for any indirect or consequential loss or damage arising under these Terms or in connection with the use of, or inability to use, the Webtool.

7. Changes to Terms

The Council reserves the right to modify these Terms at any time. We will make efforts to notify users of any changes, but it is also your responsibility to check these Terms periodically for changes. Your continued use of the Webtool following the posting of changes will mean you accept and agree to the changes.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
